REQUIREMENTS FOR THE GRANT OF PLANNING PERMIT

INTRODUCTION

This information leaflet is prepared at the instance of the Permanent Secretary, Ministry of physical Planning & Urban Development (MPP&UD).

The leaflet is considered germane as a summary of information for professionals and non-professionals in the built environment that may be seeking information on the materials and procedures for the processing of planning permits in the state.

The information leaflet is therefore an improvement on the existing level of information. It encapsulates contemporary, technical and material requirements for planning permit processing. The information, among others would improve information dissemination, understanding and invariably compliance with basic minimum standards. The information leaflet has been streamlined into modules for ease of comprehension and reference. The modules are as follows:-

MODULE I-      TECHNICAL REQUIREMENTS

MODULE II-      REQUIREMENTS FOR PLANNING PERMIT 

                              PROCESSING.

      MODULE III-    SPATIAL DISTRIBUTION OF PLANNING PERMIT 

                                    OFFICES WITH IN THE STATE.

 MODULE I:   DOCUMENTS REQUIRED FOR THE GRANT OF PLANNING  

                        PERMIT PROCESSING 

1.0    CATEGORY A (NEW APPLICATIONS)  

 Ground Floor and 1st  Floor

1.  Proof of Land ownership. It could be any of the following:-

  • C of O,
  •  Governor’s Consent,
  • Conveyance,
  • Letter of clearance from LUAC,
  • Letter of confirmation from Land Services.

2.  Receipts of payment of statutory fees.

  • Processing fee to LASG,
  •  10% LPO fee,
  • Spatial enhancement fee,
  • LASEMA (Where applicable),
  • Infrastructural Development Charge (IDC) (Where applicable),
  • Penal fee (where applicable). 

DOCUMENTS REQUIRED FOR THE GRANT OF PLANNING PERMIT PROCESSING

Ground Floor and  1st  Floor

4.  Evidence of Tax payment by applicant.

5.  5 sets of Architectural drawings duly stamped and sealed with ARCON stamp.  

6.  5 sets of Structural Drawings to be supported with;-

    -Letter of Supervision

    -Calculation Sheets

7.  Mechanical and Electrical Drawings in case of Public  use (Commercial & public institutions)

8.     1 Sun print of Survey Plan or Beacon Sheet.

9.     Submission of a comprehensive site sketch of the subject site covering a 250m radius.

9.     2 copies of Physical Planning Technical Report in case of Commercial, Industrial, Institutional, POW, Residential of more than eight (8) family units.

8.     Submission of a comprehensive site sketch of the subject site covering a 250m radius. 

DOCUMENTS REQUIRED FOR THE GRANT OF DEVELOPMENT  PERMIT PROCESSING

2nd Floor and above

1.  Proof of Land ownership. It could be any of the following:-

  • C of O ,
  • Governor’s Consent,
  • Conveyance,
  • Letter of clearance from LUAC,
  • Letter of confirmation from Land Services.

2.  Receipts of payment of statutory fees.

  • Processing fee to LASG.,
  • 10% LPO fee,
  • Spatial enhancement fee,
  • LASEMA (Where applicable),
  •  Infrastructural Development Charge (IDC) (Where applicable),
  • Penal fee (where applicable). 

DOCUMENTS REQUIRED FOR THE GRANT OF DEVELOPMENT  PERMIT PROCESSING

10.           Submission of Planning Brief prepared by a Registered Town Planner, duly stamped and sealed with TOPREC Seal

CATEGORY B  (SPECIAL APPLICATIONS)

SPECIAL APPLICATIONS:

These are the applications that are considered to have certain peculiar characteristics in terms of intensity of use, strategic and special requirements in areas of physical, environmental, Governmental and Socio-Economic demands/ needs of the individual, Government and Non- Governmental Organisations.

Some of these needs could be as a result of the emerging trends in technology and modernity. These include but not limited to the following:

1.     Petrol Filling Station (PFS),

2.     Eatery,

3.     Banks,

4.     Gas Plant,

5.     Place Of Worship (P.O.W)

6.     Hotel 

 CATEGORY B  (SPECIAL APPLICATIONS)

7.     Events Centre,

8.     Golf Course,

9.     Large Scale Developments,

10.  Independent Power Projects

11. Telecommunication Mast,

12. Residential of more than 8 family units,

13. Shopping complex.

General Requirements for 2nd Floor and above

1.  Proof of Land ownership. It could be any of the following:-

  • C of O or
  • Governor’s Consent or
  • Conveyance,
  • Letter of clearance from LUAC,
  • Letter of confirmation from Land Services.

2.  Receipts of payment of statutory fees.

  • Processing fee to LASG.,
  • 10% LPO fee,
  • Spatial enhancement fee,
  • LASEMA (Where applicable),
  • Infrastructural Development Charge (IDC) (Where applicable),

Penal fee (where applicable).

3.  Evidence of Tax payment by applicant.

4.  5 sets of Architectural drawings duly stamped and sealed by Registered Architect.  

CATEGORY C  (EXISTING BUILDINGS)

 APPLICATION ON AMENDEMENT OF EXISTING STRUCTURES 

3.  Evidence of Tax payment by applicant.

4.  5 sets of Architectural drawings duly stamped and sealed by Registered Architect (where applicable).  

5.  5 sets of Structural Drawings duly signed and sealed by a Registered Engineer. (where applicable). The drawings are to be supported with;-

  • Letter of Supervision
  • Calculation Sheets
  • Letter of structural stability

6.     1 Sun print of Survey Plan or Beacon Sheet.

7.     Certified True Copy of Insurance Certificate

8.     Photocopy of Former Approved Building Plan.

9.     Material Testing Investigatory Report

 

MODULE II

TECHNICAL REQUIREMENTS FOR THE GRANT OF DEVELOPMENT PERMIT

SPACE STANDARDS FOR RESIDENTIAL DEVELOPMENT

1.     All habitable rooms shall not be less than 3m x 3.6m (10.8m2)

2.     All rooms must have cross ventilation

3.     The minimum height of living rooms, kitchen, and all other rooms shall not be less than 2.7m

4.     The floor area provision for kitchen facility shall be in line with Architect data/Building code

5.     The floor area for convenience (toilet and bath facilities) shall be in line with Architect data/Building code.

6.     A minimum of two staircases shall be provided for any proposal more than one family unit above the ground floor.

7.     The width of each of the staircases shall not be less than 900mm.

8.     The risers / goings of all stairs shall be in line with Architect data/Building code

9.     Adequate emergency exits must be provided.

10.                       No of Risers should not be more than 13.

TECHNICAL REQUIREMENTS FOR THE GRANT OF DEVELOPMENT PERMIT

12. Scale and Sheet to be used for submission  of Plans shall be at the following scale and standards:

SHEETS

a)    (i)  Sheet size A2 420 x 600mm

            (ii) Sheet size A3 300x 420mm

SCALES

b)    (i)  Plan section, Elevations for Architectural, Structural, Sanitary and Plumbing; Plumbing and Mechanical; 1: 100

c)     (ii)  Block Plan 1:200

d)   (iii) Location or Layout Plan 1:500

PANEL: The panel of the detailed particulars of the applications and Relevant Registered Professionals  shall be at the base of the drawings with appropriate sheets  and scales

  • N.B: Please note that ,The name(s) or Trade Name, Registered Office and any other particulars of the Architect ,Builders ,Engineers, Town Planners as well as the name , Registered Office and the occupation of the Developer or his Agent with the date of preparing the drawings  and other details shall be  on the applications and the drawings.

  • Standard plot =  Maximum of 12m excluding domes or minaret structures   
  • Substandard plot =  Maximum of 6m excluding domes or minaret structures   

7.  Permissible Uses:

i)   Permissible uses for standard plot:-

  • Vicarage                  
  • worshipping area
  • Vestry
  • Library
  • hall
  • Admin.
  • Minaret/Tower                
  •  Store, etc.  

ii.  Provision for substandard plot:

Assembly hall & toilet; resting/ablution.

  • 400m  radius  (different sect.)
  • 800m radius (same sect)

9.  Car Parking Space:

  • Substandard plot =1 car park per 75m² of Worshipping area.
  • Standard    plot= 1 car park per 40m² of Worshipping area.

5.     Preparation and Approval of Layout Plans for both Government and Private Lands including Excised Villages.

6.     Granting of Development Permits 

7.     Development Control and Removal of Illegal structures

8.     Urban Renewal and Regeneration.

      The dissemination of information is very important in every society. It keeps the society as well as organization going.

      It is however believed that the information leaflet shall be updated (from time to time) in response to the emerging changes  in view of political, Legal, technical, Physical and Socio-economic dynamism in  the state.
